Compoundable vs. Non-compoundable Offence
Let's break it down in a way that's easy to remember...
One simple formula to remember this:
Compoundable = Compromise | Non-compoundable = No Compromise
Let's get into the details now...
NATURE OF OFFENCE
There are different types of offences. Some are heinous & serious and have a grave impact on society. While others impact a person or group of individuals. Depending on the nature (gravity) of the offence, the law clubs these offences as Compoundable & Non-Compoundable.
WHAT'S A COMPOUNDABLE OFFENCE?
Those offences which can be compromised, i.e. the complainant & accused can reach a settlement/agreement/compromise & the complainant agrees to take back the charges levied against the accused.
WHAT'S A NON-COMPOUNDABLE OFFENCE?
Certain offences are too serious/heinous in nature to be compromised upon. These offences have a serious impact on the society. For example, Murder, Rape, Dacoity, etc. cannot be compromised even if the complainant and accused decide to settle the issue amongst each other.
WHERE DO I FIND THE LIST OF COMPOUNDABLE & NON-COMPOUNDABLE OFFENCES?
