What To Do When Someone's Cheque Bounces?
So, you got a cheque and even though it is super inconvenient, you made a trip to the Bank or an ATM vestibule and dropped/deposited your cheque. YAY!!!
Now, you're waiting with bated breath for the money to get credited in your account. [Let's admit it, we all love it when more money gets added to our bank balance]
But lo and behold, you find out that the cheque was dishonoured [commonly referred to as 'Cheque Bouncing']. :(( [Boo-hoo=hoo]
So, what do you do now?
Well, it's pretty simple
1) NOTICE: Send a notice - in writing - to the person whose cheque has been dishonoured. Inform him/her that their cheque has bounced and ask them to make the payment within 15 days of the receipt of notice.
Remember: Its 15 days from the date of receipt of notice
2) If you receive the money -- Well and good. Smile at your increased liquidity :D
3) If you don't receive the money -- File a case as per Section 138 of The Negotiable Instruments Act, 1881.
Punishment:
(a) Imprisonment for a term which may extend to two (02) years OR
(b) with fine which may extent to twice the amount of the cheque OR
(c) with BOTH
